Reminders
ECF Reminder for Attorneys
As you already know each firm is different as to how they manage
attorney ECF accounts within their firm. Some firms require the
Managing Attorney’s Office to handle everything and some require
the attorneys to mange it themselves. No matter how it’s being
managed there should be a reminder once or twice a year to make
sure the attorneys that are allowed to sign court filings are up
to date within the local courts as to having passwords. For
example, some firms only allow partners to sign court filings. If
partners are only allowed to sign court filings then a reminder
should be added as to when that firm generally announces new
partners to make sure the new partners have passwords for all
local courts.
*On a side note please make sure you also keep track of the five
year renewal period in the Second Circuit Court of Appeals.
Local Rule 46.1 Attorney
Admission
(2) Renewal of Admission; Failure to
Renew; Inactive Status. An attorney is admitted for a period of
five years, and must renew admission every five years for an
additional five-year period. Renewal requires submission of an
attorney admission renewal application. An attorney who fails to
renew admission within one month after the expiration of the
five-year period is placed in
inactive status. An attorney in inactive status must complete the
renewal process to practice before the court. After 12 months in
inactive status, an attorney is removed from the court’s admission
roll and must reapply for admission in accordance with (a)(1).
Eastern District of New York ECF Reminder
While on the topic of ECF accounts we noticed the Eastern District
of New York has recently updated their ECF Quick Reference Sheet
for Attorneys. As you already know the Southern and Eastern
Districts of New York operate differently as how you receive ECF
notifications in cases you are not a party to. The Southern
District allows you to manage that through the attorneys account
along with adding secondary email addresses. The Eastern District
of New York used to require you to call to have that done, but they
have amended that process. We thought it would be a good idea to
not only provide the section from the Eastern District of New York
that mentions what the procedure is, but to also include the
entire section below.
ECF Registration/Customer Support Quick Reference Sheet for
Attorneys
To view documents and docket sheets - an attorney will need to
register for a PACER login and password:
PACER 1-800-676-6856
http://pacer.psc.uscourts.gov
To e-file documents in EDNY, you need to register for a login and
password:
Go to the court’s website:
www.nyed.uscourts.gov
Online Registration is located under the blue tab, "for Attorneys"
-click on "CM/ECF Attorney Account Registration"
Registrant must click on link in the confirmation e-mail for
registration to
be processed.
Password is issued within 1 (one) Business day* in most
circumstances.
(*If attorney did not receive confirmation email within this time
frame, they should check their SPAM filter)
Lost ECF Password:
Option 1: Go to the Lost Password link, which is located on the
ECF Authentication screen For this to work, the attorney must know
their login and their e-mail address must be correct in our ECF
database.
Option 2: Re-register on the website (www.nyed.uscourts.gov)
To update contact information on ECF:
If the attorney is currently appearing on an active case(s): a
Notice of Change must be e-filed in each case. If no active cases,
attorney should re-register on the website to update their contact
information.
To receive ECF notification on a case:
An attorney appearing on a case should e-file a Notice of
Appearance in the case.
If a registered attorney wishes to be notified of case activity in
a case they are not appearing on, the attorney may send a request
with their full name, ecf account login ID, and the case number(s)
to:
support@nyed.uscourts.gov.
To add a secondary email
addresses to an attorney’s account for ECF notifications: Send an
e-mail request with the attorney’s name and bar code to:
support@nyed.uscourts.gov.
Proper registration does not guarantee you will receive
all ECF Notices
We are unpleasantly surprised to see how many ECF notices are not
received by law firms and how many changes to PACER dockets are
not emailed out at all. As more and more clients implement
